Judge Rules R. Kelly Child Porn Case Must Continue
R. Kelly didn't get the decision he wanted Friday (October 28), when a judge ruled against throwing out his child pornography case.
According to the Associated Press, Cook County Judge Vince Gaughan ruled that the 33-month window prosecuting attorneys say Kelly allegedly made a video of himself engaging in sex acts with an underage girl is narrow enough for Kelly to defend.
Last month, Kelly's attorneys won a small victory when Gaughan ruled that prosecutors must narrow down the original timeframe of Nov. 1, 1997, to Feb. 1, 2002 of when the alleged tape was made to a more specific window of time. Illinois case law didn't allow the prosecution to be so vague, said the judge.
Kelly's attorneys filed motions that suggest he may argue that the tape was made at the end of that time span, when the girl would have been 17 years old.
