Shyne Judge Bows Out, Cites Conflict of Interest
Shyne recently suffered a setback in his attempt to gain access to money he's earned since he's been incarcerated.
According to the New York Post, Justice Howard Ruditzky stepped down from presiding over a civil lawsuit filed by patrons injured during the December 1999 shootout at Club New York. The judge said he could not hear the case because Dershowitz and Dershowitz law firm that previously represented the rapper had also represented his brother-in-law, which presented a possible conflict of interest.
The hearing scheduled for yesterday (March 20) had already been continued from earlier this month, and will now be further delayed.
As sources previously reported, Shyne's attorney's had hoped to challenge the nearly 30-year-old "Son of Sam" law which bars convicts from making money off anything related to their crimes. Shyne had hoped to be allowed access to over half a million dollars in recording contract advances and royalties, funds which were frozen by Brooklyn Supreme Court Justice Michael Garson last year.
Owen Michelen, the defense attorney representing Shyne, has argued that the money in question is not related to the shootout and that it will help pay any settlement or jury verdict awarded to the plaintiffs.
In related news, Shyne recently converted to Judaism and changed his name to Moses Michael Leviy.
Shyne is currently serving a ten-year sentence for his part in the Club New York shooting. He signed a multi-million deal with Def Jam Records in 2004 and released the album God Father Buried Alive in the same year.
