Ludacris, Kanye West and the Universal Music Group are headed to court on Monday (May 22) as the copyright infringement lawsuit against them begins in New York's Southern District Federal Court.
New Jersey-based rap group I.O.F. is alleging that Luda and Kanye jacked the chorus from "Straight Like That" for Luda's "Stand Up." Luda performed the song while West produced it.
Judge Kevin Castel will oversee the case, while I.O.F. is being represented by Mel Sachs, Lil' Kim's former lawyer.
Last July, a New York Federal Judge denied Ludaris and Kanye's motion to have the case dismissed, forcing the duo to stand trial. Universal, Luda and Kanye are being sued for $10 million in damages.
The suit was first filed back in 2004. Several months after the suit was filed, I.O.F. released the dis track "Fuck Ludacris," claiming that Luda subliminally aimed at them on "Pass Out" off the emcee's Red Light District album.
BMS Entertainment CEO Jeff Billingsley says Luda was personally given a copy of "Straight Like That" on three separate occasions while Kanye received one copy. BMS and I.O.F. say they gave the artists the CD at MTV and BET studios. The group also holds favorable reports from an expert musicologist.
