The federal judge presiding over the wrongful death lawsuit filed by the family of slain rapper Christopher "Notorious B.I.G." Wallace against the city of LA denied a bid by the family to expand the lawsuit on Thursday (August 10).
As SOHH previously reported, the Wallaces' attorney's requested last month that the suit should include claims that LAPD officer Rafael Perez was on duty at the Peterson Automotive Museum, where Biggie had attended a party before being shot and killed.
Voletta Wallace, B.I.G.'s mother, and his widow, Faith Evans, sued the city of Los Angeles and others four years ago, alleging wrongful death, and accused convicted corrupt cops Rafael Perez and David Mack of conspiring to kill Biggie with Death Row CEO Marion "Suge" Knight.
U.S. District Judge Florence-Marie Cooper, who denied the motion on Thursday, ruled that there was "no admissible evidence that Perez was on duty...at the scene of the murder," according to the Associated Press.
Cooper recently postponed the retrial of the wrongful death lawsuit until January of last year. She also declared a mistrial in the suit last summer.
