  • Proof's Killer Found Guilty, May Only Be Sentenced To Probation

    Mario Etheridge, the man who shot and killed D12 member Proof at Detroit's C.C.C. nightclub in April, was found guilty of two weapons charges yesterday (September 20th).

    According to The Detroit Free Press, Etherdige, 28, was convicted of carrying a concealed weapon, a felony with a maximum penalty of five years in prison; and discharge of a firearm in a dwelling or occupied structure, a felony with a four-year maximum sentence.

    Etheridge was not charged with Proof's murder. In August, Wayne County Prosecutor Kym Worthy declined to pursue murder charges against Etheridge saying that he had acted in self-defense when he shot Proof, who had shot his cousin, Keith Bender.

    Proof (born Deshaun Holton) and Bender got into a heated dispute at the C.C.C. on April 11. The Detroit bred rapper pistol-whipped and shot Bender, and was then gunned down by Etheridge.

    Wayne County Assistant Prosecutor Elizabeth Walker, who at the opening of the trail argued that no gun play would have occurred if Etheridge never fired warning shots to quell the fight between Bender and Proof, revealed that Etheridge could be sentenced to probation because he has no prior criminal convictions.

    "No one can calm a violent situation down by introducing a weapon," Walker said Wednesday. "Today's verdict proves this."

    Randall Upshaw, Etheridge's lawyer, who had argued his client's act was self defense, did not return phone calls after the verdict.

    Etheridge's sentencing will take place on October 17. If he is sent to prison, he faces a five year maximum sentence.
