      Kobe's Court Case News: Post your thoughts

      A judge rejected Kobe Bryant's request to skip next week's initial court appearance in his sexual assault case, his attorney said Thursday.

      Hal Haddon said the request was filed Thursday morning and rejected a few hours later by Judge Fred Gannett. Haddon commented during a break in a hearing on a media organization request to see sealed court records in the high-profile case.

      Chris Beall, representing several media organizations, argued the NBA superstar waived his right to privacy when he declared his innocence at a news conference hours after the sexual assault charge was filed.

      Beall said the presumption of public access to court records is "a hallmark of our judicial system.''

      "Every day that goes by when the public doesn't have an opportunity to understand the evidence is a day lost under the Constitution,'' he said in a courtroom filed with reporters.

      "The defendant has asserted that the release of the arrest warrant and search warrant affidavit will harm his right to privacy,'' he said. "However, the defendant has made admissions on international TV of a sexual relationship he says was consensual with the victim. That statement is a waiver of his right to privacy with respect to those facts.''

      District Attorney Mark Hurlbert and defense lawyers have argued the records should be withheld because publicity could affect Bryant's right to a fair trial.

      The judge said he would not rule before Bryant's court appearance Wednesday.

      Bryant is charged with sexually assaulting a 19-year-old woman. The 24-year-old husband and father of one says he had sex with the hotel worker but denies he sexually assaulted her. He is free on $25,000 bond.

      Much of the information about the allegation against the Los Angeles Lakers star has been sealed, such as the arrest affidavit and court records that could provide clues to the evidence.

      Gannett has ordered a limit on public comment about the case by attorneys, authorities and others, including Bryant and any witnesses. He said the order was necessary to guarantee a fair trial.

      Gannett also has warned organizations not to publish or broadcast the name or photograph of any witness, juror, potential juror or the alleged victim and her family on the courthouse grounds. Any organization violating the order could be denied a seat in the courtroom.

      Hurlbert has said he had both physical and testimonial evidence to prove the case. He said Bryant forced the victim into "submission'' through physical force but refused to disclose other details.

          They are both pitiful human beings...... him for cheating by inviting a tasty little groupie to his room (irregardless of what they did when they got there).... her for consenting to "sexual activity but not intercourse" (her words, not mine) with a man.... any man... that she just met.....

          They BOTH need serious in-patient counseling..... if you stand up for either of them, you cheapen our society and lower our value as human beings. There is no victim here but American values.

            THIS IS THE WEAKESS RAPE CASE ON RECORD. THE MERE FACT SHE CONSENTED TO ANY SEXUAL ACTS WITH KOBE, WHEN SHE JUST MET HIM 2 HOURS BEFORE, MAKES ME NOT BELIEVE HER. WHO IS TO SAY SHE DIDN'T AGREE TO ANAL SEX BUT AFTER SHE FELT HIS 10 INCHES UP HER ASS DECIDED IT DIDN'T FEEL THAT GOOD AND SHE WOULD THEN SAY "HE RAPED ME." THAT'S WILL NOT PLAY FOR A COURTROOM.               Radio superstar Tom Leykis banned from saying 'Kate Faber'



              Freedom of speech came to a grinding halt today as famed radio personality Tom Leykis was instructed to cease using the name of Kobe Bryant's alleged victim, Kate Faber. Leykis broke the news to his listeners during the opening hour of his syndicated radio talk program.

              "I don't understand how some judge in Colorado has the authority to suspend the constitutional rights of someone in California," Leykis said.

                Ok, Jesus himself!

                We have entirely too many Hypocrits in our community. I mean really. So many people cheat on their wifes atleast once. Bill Cosby, Reggie Jackson, Michael Jordan (white Girl) there have been so many people that have done this. Reggie Jackson actually gave Robbin Given's mother (Ruth Givens) an STD while both of them were married. The fact that 50-80 % of people cheat on their spouses atleast once does not make it right but It makes it understandable.
                So I don't understand why anyone would think that they are "pure" enough to throw the first stone. The adultry is between him and his wife. The adultry part has nothing to do with Rape.


                The difference with Kobe is that he was well known for his clean image and that is the only difference. I personally would have told everyone I wasn't shit ahead of time so It wouldn't come as a suprise to them when I did some crazy shit.

                        Bryant Arrives at Courthouse, Informed of Next Steps

                        NBA superstar Kobe Bryant made his first court appearance on a sexual assault charge Wednesday, uttering just two words during a seven-minute hearing that created a media frenzy in this quiet mountain town.

                        Attorneys for the 24-year-old Bryant waived his right to be formally advised of the felony assault charge, sparing the Los Angeles Lakers guard even more time in the granite-walled courtroom that was jammed with reporters.

                        Eagle County Judge Frederick Gannett set an Oct. 9 preliminary hearing to determine whether the closely watched case will go to trial. The hearing would be one day after a Lakers' preseason game and about three weeks before the start of the regular season.

                        Bryant spoke only once during the hearing, answering "No, sir'' when the judge asked if he objected to giving up his right to have the preliminary hearing within 30 days. He left the courthouse immediately and was expected to return to California by private jet.

                        The case has been the subject of widespread speculation about Bryant's accuser, a 19-year-old college student who worked at the front desk of the Lodge & Spa at Cordillera in nearby Edwards. Bryant was in Colorado to have knee surgery in Vail.

                        Bryant has said he had consensual sex with the hotel clerk June 30 but is innocent of assault. If convicted, Bryant faces four years to life in prison or 20 years to life on probation, and a fine of up to $750,000. He is free on $25,000 bond.

                        The judge asked the Pitkin County sheriff to investigate whether law enforcement officials were leaking details to reporters in a case he said he was drawing "extraordinary'' media coverage.

                        "I am concerned with some reports that I have seen in the press,'' Gannett said. "They appear to address issues that are not generally available to the public.''

                        Gannett has already issued a gag order in the case and is weighing media requests to release court records.

                        The hearing was held amid a media circus that included hundreds of reporters and photographers who swamped the courthouse grounds before a hearing that was carried live on national cable networks. Even the jury box was filled with courthouse employees eager to catch a glimpse of the celebrity defendant.

                        Clad in a cream-colored suit, Bryant strode in between his two attorneys and kept his gaze fixed on Gannett. He was in and out of the courtroom in about eight minutes.

                        Outside it was a different story, with about 100 supporters watching the arrival and departure of one of the NBA's brightest young stars. There were cheers when he came and went, and someone called out "Kobe is innocent!'' as he arrived in a sport utility vehicle.

                        His wife, Vanessa, who appeared by his side when he tearfully confessed to adultery, was not present.

                        Bryant had tried to get out of the appearance, which meant little legally but provided the world images of the basketball star standing before a judge in a case that has already damaged his career.

                        Robert Pugsley, a criminal law professor at Southwestern University in Los Angeles, predicted Bryant would testify at the Oct. 9 hearing.

                        "I don't think he's going to want to miss an opportunity to present his side of the story,'' Pugsley said.

                        Lakers spokesman John Black said it was too early to tell how the Oct. 9 hearing date will affect Bryant's preseason.

                        "We'll sit down with Kobe at some point when it makes sense to do that and discuss his plans with him at that time,'' Black said.

                        At times, preparation for Bryant's arrival looked more like something for a head of state. A media tent was erected outside the courthouse, authorities brought out the county's only metal detector and sheriff's deputies were called in on overtime to keep order.

                        Along with the journalists came Bryant's fans -- people like Eric Tison, 30, who drove three hours from Castle Rock, south of Denver.

                        "I hope he's innocent. I'm here to support him as a basketball player,'' said Tison, wearing a Los Angeles Lakers No. 8 jersey and hoping for an autograph. "What goes on in his personal life now is taking away from the game.''

                          Sources: Anal intercourse rumor untrue

                          Another rumor bit the dust Wednesday when sources said stories about anal intercourse between Kobe Bryant and his alleged victim are not true.

                          A rumor has rocketed across the country that the incident between Bryant and the 19-year-old woman Eagle woman he allegedly sexually assaulted stopped being consensual when Bryant demanded and may have tried to force anal intercourse.

                          Not true, sources close to the investigation told the Daily.

                          While sources stopped short of saying the word "anal" would not come up at the trial, they did say the story about acts of anal intercourse or demands for it were not accurate.

                          Sources said that when the case finally hits trial, it will center on the physical evidence, which sources call "abundant," and the assertion that the alleged victim wanted to leave the room but Bryant did not allow her to leave.

                          Bryant's arrest warrant included a misdemeanor count of false imprisonment. In Colorado, that means simply that someone wanted to leave an area or situation, but was physically kept from doing so.

                          The story is one of dozens shooting back and fourth across the country, aided by the Internet, as rumors swirl about this summer's highest profile story.

                          Among other rumors and reports that Daily sources declare are not true:

                          - The woman whom Bryant allegedly assaulted received a ride home. Not true. Reports that her clothing was torn are also untrue, sources said. Sources said that the alleged victim managed to get herself home by 11:50 p.m. June 30, after ending the shift at the Lodge at Cordillera at around 11:10 p.m. They also said that although her clothing was disheveled and showed signs that something has occurred, it wasn't torn or ripped, as some reports indicated.

                          - The woman made previous charges of sexual harassment against another hotel worker at the Lodge at Cordillera. Not true. Another female employee did so, which led to the termination of a Cordillera employee.

                          - The woman was in Kobe Bryant's room for up to two hours. Not true. She was there for about 20 minutes.

                          - The woman was hysterical when she returned to the hotel lobby from Bryant's room. Not true. She was in a state of shock and stupor, sources said.

                          - There was a large disturbance during the time of the incident. Not true.

                          - Eagle County Sheriff Joe Hoy is personal friends with the woman's family. Not true.

                          - An attorney in the District Attorney's Office is related to someone in the Eagle County attorney's office. Not true. They share the same last name as the alleged victim, but are not related and had never met.

                          - Physical evidence alone is enough to convict Kobe Bryant. Not true. Sources have said there is an abundance of physical evidence, although Hurlbert has steadfastly refused to comment on anything regarding the case. Hurlbert did say, though, that no part of the evidence was any more important than any other, and that it was the sum of the evidence being greater than its individual parts that convinced him to charge Bryant with one count of felony sexual assault.

                          - Bryant can pay off the alleged victim to get out of this. Not true. It is now a matter for the courts and beyond the control of the alleged victim, even if she wanted to call it all off.

                            Kobe Bryant's account of the night in Question:

                            The gal came up to his room. After they had sex, Kobe wanted her to leave. However, she wanted to stay the night. Kobe got pissed and either he or a bodyguard tossed her ass out. Needless to say she got pissed off and started freaking out.

                            Some of the physical marks on her happened during the struggle, while being thrown out of the hotel room.

                            Apparently, she also scratched the hell out of Kobe's back during sex. This could indicate either Kobe was holding her down and she was struggling or she is just a psycho and scratched him to make her mark.


                            Kate Faber's account of the night in Question:

                            She said that after a requested tour around 10:15 pm that lasted about 20 minutes, she returned to her post at the front desk to finish her shift. Mr. Bryant had requested she join him in his room but she refused. Shortly before 11:00pm when her shift ended, Kobe returned to the desk with a friend/bodyguard and told her he would give her some autographed stuff like jerseys, or pictures or something, if she would just stop by his room before she left the hotel. She then agreed and did so.

                            While there, Kobe chatted with her awhile and then tried to kiss her. She initially refused, but then let him. She was "uncomfortable" but was star struck and thought it would be safe to go that far. Kobe then began to grope her breasts and butt, and then proceeded to remove her clothes and rape her.

                            She is only about 5'8" and was unable to physically resist him. When things got out of hand she began to scream for help. The hotel reports that several guests reported a disturbance coming from the room sometime after midnight.


                            Didn't he use a condemn? If so her story does not make since because he could not have put the condemn on and hold her down at the same time. It would make more since If she started to have sex and then she wanted to stop because he wouldn't have had to put on the condemn and hold her at the same time but based on her account he would have had to hold her and put on the codemn with one hand. I use two hands when putting on a condemn.
